Terms of Use

1. Use of the Site

You may use the Site to learn about our services and to contact us. You agree not to:

• Use the Site in any way that violates applicable law.
• Submit false, misleading or someone else's information.
• Send spam, automated or bulk submissions, or attempt to bypass our spam protections.
• Try to gain unauthorized access to the Site, its server, its admin area or its data, or interfere with its normal operation.
• Copy, scrape or republish the Site's content except as permitted by law.

2. Free homepage preview

We may offer a free homepage preview (a design mockup) based on the details you send us. The preview is free and comes with no obligation to purchase anything. Submitting a request does not guarantee that we will create a preview, and we may decline any request at our discretion.

Until you hire us and pay for a project under a written agreement, the preview remains our property. You may view and share it for the purpose of evaluating our services, but you may not use it, or have someone else build it, as your live website. Any logos, photos or text you provide remain yours.

3. Quotes, pricing and projects

Prices on the Site (for example "from $2,500" or "from $40/mo") are starting points to help you plan. They are not offers or binding quotes. Your final price, scope, timeline, launch date and payment terms are confirmed in a written proposal or agreement that we both accept. If that agreement conflicts with these Terms, the agreement controls for your project.

4. Intellectual property

The Site and its content, including text, graphics, the JrodCode name and logo, layout and code, are owned by JrodCode or used with permission and are protected by copyright, trademark and other laws. Projects shown in our "Work" section belong to their respective owners and are shown as examples of work our team designed, built or contributed to. Nothing in these Terms gives you a license to use our trademarks or content except to view the Site for its intended purpose.

5. Third-party links

The Site links to websites we do not control, such as live client and project sites. We are not responsible for their content, availability or privacy practices. Visiting them is at your own risk and subject to their terms.

6. Disclaimers

The Site is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the Site will be uninterrupted, error-free or free of harmful components. Information on the Site is general and may change without notice. Results for any business, such as search rankings, calls or bookings, are not guaranteed.

7. Limitation of liability

To the fullest extent permitted by law, JrodCode and its team will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, arising from or related to your use of the Site. Our total liability for any claim related to the Site will not exceed one hundred U.S. dollars (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you. This section does not limit liability under a separate written project agreement, which has its own terms.

8. Indemnity

You agree to defend, indemnify and hold harmless JrodCode and its team from claims, losses and expenses (including reasonable attorneys' fees) arising from your misuse of the Site or your violation of these Terms.

9. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute arising from these Terms or the Site will be brought exclusively in the state or federal courts located in Riverside County, California, and you consent to their jurisdiction.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the "Last updated" date at the top of this page. Your continued use of the Site after changes are posted means you accept the updated Terms.

11. Language

These Terms are available in English and Spanish. If there is any conflict between the versions, the English version controls.
